Terms and Definitions

  • Zoomy – CODEX CRAFTERS - FZCO.
  • Website – Zoomy.travel.
  • System – The Zoomy booking system available on the Website.
  • Client – An individual who books scooter rentals through the System.
  • Provider, Service Provider – An entity that provides scooter rental services to the Client.
  • Provider Services – Scooter rental services provided by Providers.
  • Agreement, this Agreement – This document and any related materials published on the Website or referenced in Confirmations as integral parts hereof.

Recitals

  • This document is an official offer to conclude an agreement under the terms specified herein.
  • This Agreement is concluded through the Client’s acceptance of the offer and shall be deemed in writing upon such acceptance.
  • The Agreement and any appendices are published on the Website and communicated to the Client electronically during booking.
  • The offer is deemed fully accepted if the Client books services or makes a partial/full payment under the Agreement.
  • Zoomy may revoke the offer at any time prior to acceptance.

1. Subject-Matter

  • Zoomy provides the Client access to the Scooter Rental Booking System to facilitate booking, searching for Providers, and making payments for Provider Services. The Client agrees to pay for Zoomy’s services and those of the Providers.
  • Zoomy acts solely as an intermediary, providing the following services:
    • Access to the System for Clients and Providers.
    • Enabling booking and payment for Provider Services through the System.
    • Basic assistance and support.
  • Zoomy does not provide scooter rental services; these are provided solely by Providers.
  • Zoomy’s liability is limited to operational errors and does not extend to the actions or omissions of Providers or damages caused by them.
  • The System is provided “as is”; Zoomy ensures reasonable performance but is not liable for technical failures.

2. Obligations of the Parties

  • Zoomy shall:
    • Operate the Scooter Rental Booking System on the Website.
    • Allow Providers to publish service information and ensure its availability to Clients.
    • Facilitate booking and payment functionalities within the System.
  • The Client shall:
    • Review the Agreement, System terms, and Provider information prior to booking.
    • Provide accurate and complete personal details, including passport and international driving license.
    • Be responsible for fines, damages, or violations incurred during the rental period.
    • Use the System solely for booking and avoid unlawful activities.

3. Booking and Payment

  • The Client must review all relevant information before booking.
  • Bookings are confirmed upon advance payment as specified on the Website.
  • Payment obligations are fulfilled when funds are credited to the recipient’s account.
  • The balance is paid directly to the Provider upon scooter delivery, under Provider terms.
  • Payment service fees and expenses are borne by the Client.

4. Cancellation and Modifications

  • Cancellation requests must be sent to support@zoomy.travel with “Cancellation” in the subject line.
  • Refunds are processed within 14 business days, less a 6% service fee and any applicable penalties.
  • Progressive penalties apply for cancellations made less than 7 days in advance (or 30 days for luxury scooters).
  • Providers may deny services within 24 hours of confirmation; advance payments are refunded less a 6% fee.

5. Liability and Insurance

  • Zoomy’s liability is capped at EUR 20 and does not cover lost profits.
  • Providers are solely liable for service quality and safety.
  • Clients are required to purchase or verify insurance coverage as needed.

6. Force Majeure

  • Parties are not liable for non-fulfillment due to force majeure events.
  • Refunds during force majeure are processed less Zoomy’s incurred expenses.

7. Amendments

  • Zoomy reserves the right to amend this Agreement unilaterally. Continued use of the System implies acceptance of updated terms.

8. Dispute Resolution

  • Pre-judicial dispute resolution through written claims is mandatory.
  • Disputes unresolved through mediation are subject to the jurisdiction of Dubai, UAE.

9. Final Provisions

  • Acts performed under this Agreement confirm its acceptance in writing.
  • Notices and communications are deemed valid if sent via registered email.
